Terms of Use for uPscaler

These Terms of Use (“Terms”) govern your use of the uPscaler mobile application (“App”) operated by us (“we,” “our,” or “us”).

By downloading, accessing, or using uPscaler, you agree to be bound by these Terms.

If you do not agree, please do not use the App.





1. Use of the App



uPscaler is provided for personal and non-commercial use unless otherwise permitted in writing.

You agree not to:


  • Use the App for illegal or unauthorized purposes
  • Copy, modify, reproduce, or distribute any part of the App
  • Attempt to reverse-engineer, decompile, or extract source code
  • Interfere with app functionality, servers, or security features
  • Upload harmful, abusive, or inappropriate content



We reserve the right to suspend or terminate access for violations of these Terms.





2. User Content



You retain all rights to the photos and content you upload into uPscaler.

By using the App, you grant us a limited, non-exclusive license to process your content solely for:


  • Image enhancement
  • Providing the App’s core functionality



We do not claim ownership of your photos, and we do not use them for training AI models unless you explicitly consent.





3. Privacy



Your use of uPscaler is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

By using the App, you acknowledge and accept the Privacy Policy.





4. In-App Purchases & Subscriptions



uPscaler may offer paid features, subscriptions, or consumable items.


  • Purchases are processed by the App Store or Google Play Store.
  • All payments, billing issues, renewals, or refunds must be handled through the respective store’s policies.
  • Subscription plans renew automatically unless canceled at least 24 hours before the renewal date.



We do not store or process your payment information.





5. Third-Party Services & Advertising



uPscaler uses third-party services such as:


  • Google AdMob (advertising)
  • Firebase Analytics
  • Google Crashlytics



These services may collect certain data as described in the Privacy Policy.

We are not responsible for the content, policies, or practices of third parties.





6. Intellectual Property



All trademarks, logos, graphics, interface elements, and code related to uPscaler are copyrighted and owned by us or our licensors.

You may not use them without prior written permission.





7. Disclaimer of Warranties



The App is provided “as is” and “as available” without warranties of any kind.

We do not guarantee:


  • That the App will be error-free or uninterrupted
  • That the results will meet your expectations
  • That the App will always remain compatible with all devices or OS versions



Your use of the App is at your own risk.





8. Limitation of Liability



To the maximum extent permitted by law:


  • We are not liable for indirect, incidental, or consequential damages
  • We are not responsible for data loss, device issues, or damages caused by the use of the App
  • Our total liability shall not exceed the amount paid by you in the past 12 months (if any)



Some jurisdictions may not allow these limitations, so certain terms may not apply to you.





9. Termination



We may suspend or terminate your access to the App at any time for:


  • Violating these Terms
  • Illegal activity
  • Misuse of the App



You may stop using the App at any time.





10. Changes to the Terms



We may update these Terms periodically.

If significant changes occur, we may notify users through the App or app store listing.

Continued use of uPscaler after changes means you accept the updated Terms.
